Family Law

Our family law consultancy and attorneyship service aims to produce legal solutions in disputes that fundamentally affect individuals' private lives, such as divorce, custody, alimony, and property division. As Zeynep Elif Kirişçi Law Firm, we aim to conclude these potentially exhausting processes for our clients with minimal damage, rapidly, and in accordance with the law.

Family Law and Divorce Cases

Family law encompasses sensitive legal processes that deeply affect individuals' personal and economic lives. The establishment and termination of marriage, and the resulting disputes over child custody, alimony, division of property, and compensation, each require careful legal evaluation.

As Zeynep Elif Kirişçi Law Firm, we provide transparent, solution-oriented, and professional legal consultancy in divorce cases and all family law-related processes. We evaluate each file within the framework of the parties' specific situations and keep our clients informed at every stage of the process.

Uncontested Divorce Cases

According to the Turkish Civil Code, an uncontested divorce lawsuit can be filed if the marriage has lasted for at least one year and the parties agree on all legal consequences of the divorce. To prevent future disputes, it is of great importance that the divorce protocol is prepared comprehensively.

Contested Divorce Cases

If the parties cannot agree on the terms of divorce (fault, compensation, custody, etc.), a contested divorce case arises. This trial process requires comprehensive legal follow-up shaped by the unique conditions of each family.

The main legal procedures we carry out in this process:

What Does It Cover?

Our service scope covers all processes from the establishment of the marriage union to its termination. Filing uncontested or contested divorce cases, legal division of assets, custody status of children, material/moral compensation requests, and validating foreign court decisions in Turkey (recognition and enforcement) fall within our office's area of expertise.

How Does the Process Work?

The process in family law files proceeds with the following steps:

Preliminary Evaluation: The client's requests are heard, the status of the marriage union, and possible evidence are examined.

Roadmap and Strategy: It is decided whether the process will be uncontested or contested; accordingly, a protocol or lawsuit petition is prepared.

Litigation Stage: In contested cases, evidence is presented to the court, witnesses are heard, and hearings are meticulously followed.

Precautionary Measures: During the process, requests are made for temporary custody, temporary alimony, and precautionary injunctions on assets so that the client or children are not victimized.

Decision and Execution: After the court decision is finalized, execution proceedings for the ruled alimony, compensation, or property division decisions are carried out.

Required Documents

For the process to be initiated, it will be useful to have the following documents ready during the first meeting:

Population registration copy and, if available, a photocopy of the marriage certificate

For contested divorces; potential evidence such as photographs, message records, assault reports, or hotel records supporting the claims

For property division cases; title deeds, vehicle licenses, and bank account statements

A "divorce power of attorney" containing special authorization from a notary public for divorce cases (Information required for the power of attorney will be provided by our office).
